Terms of Sale

These Terms of Sale govern buying on customcanvas.shop (the "Platform"). A summary is displayed above the Pay button and you accept them at checkout. They apply together with the Terms of Service, and the Shipping, Returns & Refunds Policy and the Listing Standards are incorporated into them.


1. Your purchase

The artist identified in the applicable listing is the seller of the artwork. Your purchase agreement for the artwork is between you and that artist, subject to these Terms of Sale and the policies incorporated into them.

Custom Canvas provides the online marketplace and facilitates payment, order communications, applicable tax collection, and certain refunds and disputes. Custom Canvas does not take title to or possession of the artwork and is not its manufacturer, creator, appraiser, authenticator, or owner.

Your payment may be processed through Custom Canvas and may appear on your statement under the Custom Canvas name. This payment arrangement does not change the artist's status as the seller of the artwork.

2. What you pay

Custom Canvas charges a service fee for operating and supporting the marketplace, including payment facilitation, transaction administration, platform security, and customer support. The exact service fee will be separately disclosed before you submit payment.

The service fee applies to each completed order and is not characterized as a surcharge for using a particular payment method.

If a discretionary change-of-mind return is approved by the artist, the service fee is nonrefundable unless otherwise disclosed at checkout. If an order is canceled because it was not shipped, or Custom Canvas determines that the artwork was lost in transit, materially damaged in transit, or materially inconsistent with the listing, Custom Canvas will refund the service fee unless prohibited by the payment processor or otherwise clearly disclosed before purchase.

Prices are in US dollars.

2A. Payment authorization and errors

By submitting an order, you authorize the disclosed charges to your selected payment method. An order is not final until payment is successfully authorized and you receive an order confirmation.

Custom Canvas may cancel or correct an order before shipment if it resulted from an obvious pricing, tax, inventory, technical, or payment-processing error. If an order is canceled for such a reason, all amounts collected for that order will be refunded.

You must not initiate a transaction using a payment method you are not authorized to use. Custom Canvas may request reasonable additional information to prevent fraud or verify a transaction.

3. Delivery

Artists ship within 5 business days of your purchase, with tracking. That window is shown on every listing. Artists are required to obtain signature confirmation on orders of $750 or more.

If your piece is not shipped in that window, the artist should tell you in Messages and offer you the choice of a new date or a cancellation. You do not have to accept a new date. If you do not, you may cancel for a full refund, and that refund does not depend on the artist agreeing to it. If the artist stops responding and neither you nor we can reach them within five business days, we cancel the order and refund you.

Your delivery address is the one you enter at checkout, and it determines the sales tax charged. Please check it — we cannot reroute a shipment after the artist has posted it.

Until your piece is delivered, it is the artist's risk, not yours. For a shipped order, risk of loss remains with the artist until carrier records show delivery to the address stated in your order; for an order requiring signature confirmation, until the required signature or other approved delivery confirmation is obtained. If a work is lost, stolen or damaged before then, you are entitled to a refund of the artwork price and shipping. Artists are required to carry commercially reasonable shipping coverage for the artwork price where it is reasonably available; your refund right does not depend on whether they do.

After valid delivery, risk ordinarily transfers to you, including the risk of theft or damage occurring after delivery. Custom Canvas may nevertheless investigate evidence of misdelivery, fraudulent delivery confirmation, or delivery to an incorrect address.

Local pickup. For a local-pickup order, you and the artist must arrange the pickup through Custom Canvas Messages and use any pickup-confirmation process provided by the Platform.

Inspect the artwork for visible damage and material inconsistencies before confirming possession. Risk of loss transfers to you when you or your authorized recipient take physical possession of the artwork and confirm pickup.

A pickup confirmation does not waive a claim involving concealed damage, fraud, counterfeit artwork, or a material misdescription that could not reasonably have been identified during pickup.

If you do not collect the artwork within the agreed period, the artist may request cancellation or reasonable storage instructions from Custom Canvas. The artist may not dispose of the artwork or impose an undisclosed storage fee without reasonable prior notice.

4. Originals, editions and condition

Every piece states its medium, dimensions and — where relevant — whether it is an original, a numbered edition, or a reproduction. Artists warrant that description is accurate.

Artwork is handmade. Minor variation in color, texture and finish from the photographs is normal and is not a defect. Genuine misdescription is a different matter and is covered below.

5. Refunds and returns

There is no automatic right of return. Refunds are artist-mediated:

  1. You request a refund from the artist in Messages, from your order.
  2. The artist decides.
  3. If they approve, Custom Canvas settles it.

On an approved change-of-mind refund you receive the artwork price + shipping + the sales tax charged on those amounts. The service fee and the tax on the fee are retained (see §2).

This is a marketplace of one-of-a-kind objects made by individual people, not a warehouse — which is why returns are the artist's decision rather than automatic.

But that discretion has a limit. If a piece never arrives, arrives damaged, or is materially not as the listing described it — wrong medium, wrong size, a reproduction sold as an original, undisclosed damage — contact the artist and then support@customcanvas.shop. Where we substantiate the claim, we will refund you whether or not the artist agrees. The artist decides about a change of mind; they do not decide whether the piece was what they said it was. Where we refund you on one of those grounds, the service fee is refunded as well.

Return requirements. A refund may be conditioned on your returning the artwork unless Custom Canvas determines that a return is unlawful, unsafe, impracticable, or unnecessary. Custom Canvas will provide return instructions, including the return address and any required tracking or insurance.

Unless otherwise stated in the return instructions:

  • you must ship the return within seven calendar days after authorization;
  • the artwork must be returned in substantially the same condition in which it was received;
  • you must use reasonable protective packaging and provide tracking;
  • the party responsible for return-shipping costs will be determined based on the reason for return; and
  • the refund may be issued after delivery and reasonable inspection of the returned artwork.

The artist will ordinarily bear reasonable return-shipping costs when the artwork was damaged, materially misdescribed, or incorrectly supplied. You will ordinarily bear those costs for an approved change-of-mind return.

You may not retain both the artwork and a full refund unless Custom Canvas expressly authorizes that result in writing.

Nothing here limits rights you have under law that cannot be excluded.

6. Disputes with your bank

If something has gone wrong, talk to us before disputing the charge. A chargeback takes weeks, and we can usually resolve it faster. If you do dispute, we will respond with the evidence we hold, including tracking and delivery records.

7. Cancellations

You may ask the artist to cancel before they ship. Once shipped, an order can only be resolved as a refund under §5.

8. Commissions

Commissioned work is an agreement between you and the artist. Custom Canvas provides the messaging and, where applicable, payment, but is not a party to it and does not guarantee the result. Currently, commissions are arranged and paid off-platform.

9. Other terms that apply to your purchase

Your purchase is also governed by the Terms of Service, and in particular by:

  • §13 (disclaimers and limitation of liability), including the cap on our total liability and the fact that we make no warranty about a work's authenticity, attribution, condition, value or provenance; and
  • §15 (governing law and dispute resolution), which provides for Texas law, a 30-day informal resolution period, binding individual arbitration with a class-action waiver, carve-outs for small claims and injunctive relief, and a 30-day right to opt out of arbitration at no cost.

Read §15 before you buy if you have not already. Nothing in these Terms of Sale limits rights you have under law that cannot be excluded.
