Terms of Service

These Terms govern use of customcanvas.shop and the services offered through it (the "Platform"). Purchases are additionally governed by the Terms of Sale; selling is additionally governed by the Artist Agreement.


1. Acceptance of Terms

These Terms constitute a binding agreement between you and Custom Canvas LLC. By creating an account, checking an acceptance box, purchasing or listing artwork, or otherwise using the Platform after being presented with these Terms, you affirmatively agree to these Terms and the policies incorporated into them.

If you purchase artwork, the Terms of Sale also apply. If you sell artwork, the Artist Agreement, Seller Protection Policy, Listing Standards, and Shipping, Returns & Refunds Policy also apply.

If you use the Platform for an organization, you represent that you have authority to bind that organization. If you do not agree to these Terms, you may not use the Platform.

2. Who may use Custom Canvas

You must be at least 18 to hold an account, whether you buy or sell. Anyone under 18 may browse Custom Canvas, but may not register, message an artist, buy, sell or post a review. If we learn an account holder is under 18 we close the account and delete the information we hold.

Custom Canvas is intended for buyers and sellers in the United States.

3. Accounts

You are responsible for the security of your account and everything done under it. Give accurate information, keep it current, and tell us promptly at support@customcanvas.shop if you suspect unauthorized access. One person, one account, unless we agree otherwise.

4. Nature of the Marketplace

Custom Canvas provides an online marketplace through which independent artists may list and sell artwork directly to buyers. The artist identified on the applicable listing is the seller of the artwork and is responsible for its description, authenticity, condition, packaging, shipment, delivery, and legal compliance.

Custom Canvas is not the artist's agent, dealer, gallery, consignee, partner, joint venturer, or employer. Custom Canvas does not take title to or possession of artwork listed through the Platform.

Custom Canvas facilitates transactions by operating the Platform, arranging payment processing, calculating or collecting applicable marketplace taxes, communicating order information, and administering certain refunds and disputes. A charge may appear on the buyer's statement under the Custom Canvas name. Payment facilitation does not make Custom Canvas the seller, owner, manufacturer, or creator of the artwork.

Custom Canvas may review artist applications and listings, but such review is not an appraisal, authentication, certification, endorsement, or guarantee of any artist or artwork. See the Listing Standards for what we do and do not check.

Commissioned work arranged through Custom Canvas is an agreement between the buyer and the artist. We provide the messaging and, where applicable, payment; we are not a party to it.

5. Your content

You keep ownership of everything you upload — artwork images, profile text, messages, reviews.

By uploading, you grant Custom Canvas a non-exclusive, royalty-free license to host, store, reproduce and display that content for the purpose of operating and promoting the Platform. Artists grant a further, still narrow, promotional license under the Artist Agreement §6. We do not sell your content, license it to third parties for their own use, or create derivative products from it.

You are responsible for having the rights to what you upload.

6. Acceptable use

Do not:

  • Infringe copyright, trademark, publicity or moral rights
  • List forgeries, reproductions passed off as originals, stolen or misattributed work, or anything else prohibited by the Listing Standards
  • Misrepresent a work's authorship, medium, age, edition, condition or provenance
  • Harass, threaten, defraud, spam or impersonate anyone
  • Transact off-platform to avoid commission on a relationship formed here. Commissioned work is excluded from this: currently, commissions are arranged and paid off-platform by design (see §4 and the Terms of Sale §8)
  • Scrape, reverse-engineer, probe or overload the Platform, or evade rate limits
  • Manipulate reviews, saves, follows or search ranking
  • Post images that are not of your own work, or stock photography presented as your work
  • Use Messages for unsolicited marketing or chain messages

Sexual content involving a minor means immediate account closure, a report to the National Center for Missing & Exploited Children, which we are required by federal law to make, and a report to law enforcement. There is no warning and no appeal.

Disagreements about a sale are normal; contempt is not. Depending on severity we remove content, warn, suspend a shop, or close an account. Where practical we explain why and give you a chance to respond. Illegal activity is reported.

Reporting. Report a message or a listing from the item itself, or write to support@customcanvas.shop. Tell us what you saw and where.

7. Copyright — DMCA

We respond to notices of claimed infringement under the DMCA and terminate repeat infringers. See the DMCA & Copyright Policy for how to send a notice or counter-notice, and for our designated agent's contact details.

8. Reviews

Only a buyer with a delivered order may review it, once. Reviews must be honest, first-hand, and about the work and the transaction.

Do not write or solicit fake reviews, offer anything in exchange for a review, or review your own work or a competitor's.

We remove reviews that are fake, incentivized, defamatory, or contain someone's personal information. We do not remove a review simply because it is negative, or because an artist dislikes it.

9. Messaging

Messages between buyers and artists are private to those two parties, except that we may access them to investigate a report, a dispute, or a legal obligation.

Messages are for talking about art, commissions and orders. Do not use them for unsolicited marketing, chain messages, or to push a buyer off-platform to avoid commission on a relationship formed here. Commissions are the exception and are currently arranged off-platform by design.

You may block another user. Blocking stops them contacting you.

9A. Local transactions and personal safety

Custom Canvas does not supervise meetings, local pickups, studio visits, or other in-person interactions. You assume the ordinary risks associated with voluntarily meeting another user.

Users should meet in a public, well-lit location when reasonably possible, avoid sharing unnecessary personal information, inspect artwork before confirming pickup, and use the Platform's designated pickup-confirmation process.

You may not use threats, coercion, weapons, unlawful substances, or unsafe conduct in connection with a transaction. Immediately contact emergency services if you believe anyone is in imminent danger.

Custom Canvas does not guarantee the identity, background, intentions, conduct, or safety of any user, except to the extent expressly stated in a separate written verification policy.

10. Fees

Buyers pay a service fee to Custom Canvas for operating and supporting the marketplace, including payment facilitation, transaction administration, platform security, and customer support. The exact amount is disclosed as its own line before payment. It applies to each completed order and is not a surcharge for using a particular payment method. Artists pay a commission under the Artist Agreement. Fees may change on notice; a change never applies retroactively to a completed sale.

11. Availability

We aim to keep Custom Canvas available but do not guarantee uninterrupted service. We may change, suspend or discontinue features. We are a small team; planned significant changes get notice where practical.

12. Termination

You may close your account at any time. We may suspend or close an account for breach, for legal reasons, or to protect the Platform or its users. Obligations relating to completed transactions survive.

13. Disclaimers and limitation of liability

13.1 As is. Custom Canvas is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Platform will be uninterrupted, secure or error-free.

13.2 About the artwork. Artists describe, price, pack and ship their own work. We do not appraise, authenticate or independently verify any piece. We make no warranty about any artwork's authenticity, attribution, condition, value or provenance. Your rights as a buyer come from the Terms of Sale and from law, not from this section.

13.3 Exclusions. To the fullest extent permitted by law, Custom Canvas is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or reputational harm.

13.4 Cap. Our total aggregate liability arising out of or relating to these Terms is limited to the greater of (a) the total amount you paid or received through Custom Canvas in the twelve months before the event giving rise to the claim, or (b) $100.

13.5 What is never limited. Nothing here limits liability that cannot be limited by law — including fraud, willful misconduct, or death or personal injury caused by negligence — or our obligation to remit money we have actually collected on someone's behalf. Some states do not allow certain exclusions, so parts of §13 may not apply to you.

14. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless Custom Canvas LLC and its officers, members, employees, contractors, and affiliates from third-party claims, damages, judgments, liabilities, penalties, and reasonable legal expenses arising from:

  • content you upload or submit;
  • artwork you list, sell, ship, deliver, or represent as your own;
  • your infringement or alleged infringement of another person's intellectual-property, privacy, publicity, or other legal rights;
  • your violation of these Terms or applicable law; or
  • your fraud, negligence, willful misconduct, or misuse of the Platform.

This obligation does not apply to the extent a claim results from Custom Canvas's own negligence, willful misconduct, or violation of law.

Custom Canvas will provide reasonably prompt notice of a covered claim. You may control the defense with qualified counsel reasonably acceptable to Custom Canvas, but you may not settle a claim in a manner that admits wrongdoing by or imposes an obligation on Custom Canvas without its prior written consent.

15. Governing law and dispute resolution

15.1 Governing law. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules.

15.2 Talk to us first. Write to support@customcanvas.shop. We each agree to try in good faith to resolve any dispute informally for 30 days before starting a formal proceeding. Most problems are a misunderstanding about an order and are fixed in a day.

15.3 Arbitration. If informal resolution fails, any dispute arising out of or relating to these Terms or your use of Custom Canvas will be resolved by binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Harris County, Texas, or conducted remotely or by written submission at your election. Judgment on the award may be entered in any court of competent jurisdiction.

15.4 Carve-outs. Either of us may bring a claim in small claims court, and either of us may seek injunctive relief in court to protect intellectual property or stop misuse of the Platform. Nothing here prevents you from reporting a matter to a government agency.

15.5 Class-action waiver. Disputes will be arbitrated only on an individual basis. You and Custom Canvas each waive any right to bring or participate in a class, collective, consolidated or representative proceeding. If this waiver is unenforceable as to a particular claim, that claim proceeds in court and the rest of §15 still applies.

15.6 Costs. Where you are the claimant and the amount in dispute is within the limit of a Texas small claims court, Custom Canvas will pay the AAA filing and administrative fees exceeding what a court filing would have cost.

15.7 Opting out. You may reject §§15.3–15.6 by emailing support@customcanvas.shop with the subject "Arbitration opt-out" within 30 days of first accepting these Terms. Opting out costs nothing and affects nothing else.

15.8 Venue if arbitration does not apply. Where a dispute is not arbitrated, the exclusive venue is the state or federal courts in Harris County, Texas, and we each consent to their jurisdiction.

16. General

16.1 Entire agreement. These Terms, with the Terms of Sale, the Shipping, Returns & Refunds Policy, the Listing Standards, the DMCA & Copyright Policy and the Privacy Policy, are the entire agreement about your use of Custom Canvas. Artists are additionally bound by the Artist Agreement, which controls where it conflicts with these Terms on matters of selling.

16.2 Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition or sale of substantially all of our assets.

16.3 Severability and waiver. If a provision is unenforceable it is limited or severed to the minimum extent necessary, and the rest stays in force. Failure to enforce a provision is not a waiver of it.

16.4 Force majeure. Neither of us is liable for failure to perform caused by events beyond reasonable control, including failure of a payment processor, hosting provider or carrier. This does not excuse payment of amounts already owed.

16.5 Electronic communications. You consent to receive notices, agreements and disclosures from us electronically, at the email address on your account. Keep it current.

16.6 Survival. Sections 5 (your content), 6 (acceptable use), 10 (fees), 13 (liability), 14 (indemnity), 15 (disputes) and this §16.6 survive termination.

17. Changes to these Terms

Custom Canvas may update these Terms prospectively. We will post the revised Terms and identify their effective date.

If a change materially affects fees, payment obligations, ownership rights, liability limitations, dispute resolution, seller protection, or previously completed transactions, we will provide reasonable advance notice and, where legally required or commercially appropriate, request affirmative acceptance.

Changes do not retroactively alter completed transactions. Continued use after the effective date of a properly disclosed nonmaterial change constitutes acceptance of that change.
